  1. TERMS AND CONDITIONS

  3. CompuServeCD(TM) is part of the CompuServe Information Service (the "Service")
  4. and as such a current Member's use of this CD-ROM and its contents is subject
  5. to the terms and conditions of the Service Agreement Terms to which Members
  6. have agreed.
  7.  
  8.  If you are not currently a Member, by opening this package you accept all
  9.  terms and conditions of the following agreement. Using any CompuServeCD(TM)
  10.  indicates your acceptance of these terms and conditions:

  12.  1. The CompuServe Information Service (the "Service") consists of computing
  13.     and information services and software, information and other content
  14.     provided by CompuServe Incorporated ("CompuServe"). In addition, third
  15.     parties provide information, software, and other content (collectively,
  16.     "Third Party Content") which may be accessed over the Service. These terms
  17.     and any Operating Rules published over the Service constitute the entire
  18.     and only agreement (collectively, the "Agreement") between CompuServe and
  19.     member (including its designated users) with respect to the Service and
  20.     supersede all other communications and agreements with regard to the
  21.     subject matter hereof.

  23.  2. Upon notice published over the Service, CompuServe may modify this
  24.     agreement, the Operating Rules or prices, and may discontinue or revise
  25.     any or all other aspects of the Service at its sole discretion and without
  26.     prior notice.

  28.  3. Unless otherwise agreed, member's right to use the Service or to designate
  29.     users is not transferable and is subject to any limits established by
  30.     CompuServe, or by member's credit card company if billing is through a
  31.     credit card.

  33.  4. Member agrees to indemnify CompuServe against liability for any and all
  34.     use of member's account.
  35.  
  36.  5. Member is responsible for and must provide all telephone and other
  37.     equipment and services necessary to access the Service.
  38.
